Guidelines for Choosing a Hearing Date
Motion for Relief from Stay
When scheduling a preliminary hearing on a Motion for Relief from Stay, leave one week between the deadline for objections to the motion and the preliminary hearing date. Be sure to select a preliminary hearing date which will be held within thirty (30) days of the motion filing date. In the event a date is not available, contact the Court.
Please review S.D.Ill. LBR 4001-2 for new Relief From Stay requirements, effective June 1, 2012.
Objections to Claims
Hearing dates should be determined by selecting the next hearing date that is a minimum of 10 days following the expiration of the 30 day response period.
